In 1819 the territory of Florida was ceded to the United States and Spain as an element of the Adams-Onis Treaty. As usual, the territory was divided into East and West by the Apalachicola River or later the Suwanee River. Florida State University can be traced back to the plan of the United States Congress to create a higher education system in 1823. The Florida Constitution of 1838 codified the basic system by stipulating the land allocated to schools. In 1845, Florida became the 27th state in the United States, which enabled the implementation of the resources and intentions of Congress on Florida education in 1823.

The Florida Legislature stipulated the establishment of two learning institutions on the opposite bank of the Suwannee River in a legislative bill of January 24, 1851. The legislature announced that the purpose of these institutions is to “educate men and women in all disciplines related to good general school education; then teach in mechanical arts, in animal husbandry, agricultural chemistry, basic law, and civil rights and Obligation.” By 1854, Tallahassee had established a boys’ school called the Florida College, hoping to prompt the state to take over as one of the seminaries. In 1856, the mayor of Tallahassee, Francis W. Eppes, once again provided the legislature with the land and buildings of the institute. The bill establishing the seminary in Tallahassee was passed by both houses and signed by the Governor on January 1, 1857. On February 7, 1857, the first meeting of the Education Committee of the State Theological Seminary west of the Suwannee River was held, and the institution began to provide post-secondary education to male students. Francis Eppes served as the chairman of the seminary education committee for eight years. In 1858, the seminary absorbed the Tallahassee Girls’ College established in 1843 and became a co-educational school.

The West Florida Theological Seminary is located on the property of the former Florida College, a hill, now the historic Westcott Building. The site is the oldest continuously used higher education facility in Florida. The area is located to the west of the State Capitol, formerly known ominously as the Gallows Mountain, which was the site of early public executions in Tallahassee.
